This study examines the traditional Jambi Malay inheritance law in the Batanghari Regency community. The main question in this Research is whether it has been appropriate to implement the traditional Malay inheritance law in Jambi with Islamic law. Furthermore, the aim is to obtain a complete and in-depth understanding of the implementation of the Jambi Malay Customary Inheritance Law in the Batanghari Regency Society according to Islamic law, starting from the way of distributing inheritance, the suitability of adage said adat with syara, 'syara' bound with the book of Allah with practice in the field, and syara 'solution to the customary inheritance law in Batanghari district.
Moreover, this research, conducted by using a qualitative approach, applies descriptive analytic method with subsequent stages undertaken. For instance, to collect the data, this research deals with three kinds of means, such as the technic of observation and in-depth interviews and documentation. Secondly, the determination of research subjects utilizes purposive sampling technique. Moreover, the data analysis uses an interactive analysis model, which consists of three interacting lines, namely: (1) data reduction; (2) data presentation; and (3) drawing conclusions. The data reliability concludes with participation extension techniques, observation accuracy, data triangulation and consultation.
The result of this research is the implementation of Jambi Malay customary inheritance law in the community of Batanghari Regency regarding to the Islamic law which is defined by describing the traditional adage with syara ', syara' joining scriptures. In addition, the three implementations are the distribution of inheritance which is different from syara ', then looking for the correlation between the real adat in the implementation of the Malay traditional inheritance law, and providing a solution in which consequently the Malay adat of Jambi in the community of Batanghari district is compatible with Syara'.
Ultimately, the recapitulation of this research is that basically the implementation of Jambi Malay customary inheritance law in Batanghari Regency community is different from the provisions stipulated by syara ', in which the inheritance law is Tauzi' Rabbani whose provisions have been stipulated in the Qur'an in detail. In its implementation, the Javanese Malay customary provisions take precedence in implementing the inheritance law. Indeed, the Ijbari principle applies in this case however the scholars are also allowed to share inheritance without using Ilmu Fara'id (Syara Provisions'). The solution given is through al-Taradhi and Att-Takharuj Min al-Tirkah which all lead to al-Shulhu, hence, there is no conflict between Syara 'and Adat.
